If you’re unfamiliar with courts-martial, your instinct will likely be to compare them to civilian trials. So, you might wonder if the potential punishments are similar, whether the accused has the same rights as a civilian defendant, and if a jury will be present. Today we’re tackling that last query, posing (and answering) the question: Is there a jury in a court-martial?<\/em><\/p>\n

Is There a Jury in a Court-Martial?<\/h2>\n

In short: sometimes.<\/p>\n

Although military juries<\/a> serve a similar purpose to civilian juries, they have a different title (in military parlance, jurors are known as \u201cmembers\u201d and a jury is a \u201ccourt member panel\u201d) <\/em>and some unique rights and responsibilities. In addition, they are not present at every court-martial.<\/p>\n

TYPES OF COURTS-MARTIAL<\/strong><\/p>\n

As you may know, there are three different types of court-martial: summary, special, and general. Summary courts-martial are used to review minor charges (i.e., misdemeanors), and they don’t require a jury. However, special and general courts-martial, which are reserved for serious crimes, typically include a court member panel.<\/p>\n

DEFENDANT CHOICES<\/strong><\/p>\n

The defendant can choose whether to be tried by a military judge only, a panel of officers, or a panel of enlisted personnel (in which one-third of the panel may still be composed of officers). If they choose to use a panel of members (whether officers or enlisted personnel), the members will render the verdict and impose the sentence.<\/p>\n

SELECTING MEMBERS<\/strong><\/p>\n

The charges will have been brought forward by a \u201cconvening authority,\u201d and this officer will also select each of the members. The convening authority is expected to choose members who are well qualified based on their experience, length of service, training, age, education, etc., and they can choose as many members as they like as long as they meet the minimum requirements. A special court-martial must have at least three members, and a general court-martial must have at least five members. However, if the death penalty is a mandatory sentence, at least twelve members are required.<\/p>\n

PANEL COMPOSITION<\/strong><\/p>\n

The composition of the court member panel will depend on the accused person. If the accused is a commissioned officer, for example, the members must also be commissioned officers. If the accused is a warrant officer, the members must be warrant officers or commissioned officers. If the accused is an enlisted member of the armed forces, the members must be commissioned officers, warrant officers, or (if requested by the defendant) enlisted members. Finally, all members must be senior to the accused person in rank.<\/p>\n

VERDICT<\/strong><\/p>\n

Unlike a civilian jury, members vote by secret written ballot and a unanimous verdict is not typically required, only a two-thirds majority. If the death penalty is a mandatory sentence, however, a unanimous verdict is necessary.<\/p>\n
