For example, children are expected to respect their parents, and&nbsp;employees are expected to be polite and professional. In the military, acting in a way that is fitting and appropriate of one&#8217;s position isn&#8217;t just expected; it is the law. Article 133 of the Uniform Code of Military Justice (UCMJ) defines the offense \u201cconduct unbecoming an officer and a gentleman.\u201d To learn more about this offense, including its definition and potential punishments, please scroll down.<\/p>\n<p><a href=\"https:\/\/gapasinlaw.espresso.themodernfirm.com\/wp-content\/uploads\/2016\/02\/Depositphotos_39423225_s-2015.jpg\"><\/p>\n<p><\/a><\/p>\n<div id=\"insertion_292487\" data-insertion-id=\"292487\" class=\"insertion image\"><a href=\"https:\/\/gapasinlaw.espresso.themodernfirm.com\/wp-content\/uploads\/2016\/02\/Depositphotos_39423225_s-2015.jpg\"><br \/>\n      <img decoding=\"async\" data-remove=\"true\" style=\"width: 500px;height: 290px;\" width=\"500\" height=\"290\" alt=\"Conduct Unbecoming an Officer\" src=\"https:\/\/cdn.lawlytics.com\/law-media\/uploads\/2573\/145702\/large\/Depositphotos_39423225_s-2015.jpg?1621545535\" loading=\"lazy\"><\/p>\n<p><\/a><\/div>\n<h2>Conduct Unbecoming an Officer<\/h2>\n<p><strong>DEFINITION<\/strong><\/p>\n<p>Sometimes known as \u201cconduct becoming,\u201d the offense&nbsp;<em>conduct unbecoming an officer and a gentleman&nbsp;<\/em>is defined in the punitive code of the UCMJ.&nbsp;Two elements fall under the article:<\/p>\n<p>(1) That the accused did or omitted to do certain acts; and<\/p>\n<p>(2) that, in the circumstances, these acts or omissions constituted conduct unbecoming an officer and gentleman.<\/p>\n<p>In this definition, \u201cofficer\u201d refers to commissioned officers, cadets, and midshipmen of both sexes, despite the inclusion of the word \u201cgentleman.\u201d As a gentleman or gentlewoman, one is considered to have to a duty to&nbsp;avoid \u201cdishonesty, unfair dealing, indecency, indecorum, lawlessness, injustice, or cruelty\u201d (<a href=\"http:\/\/usmilitary.about.com\/od\/punitivearticles\/a\/mcm133.htm\">source<\/a>). Any behavior or actions that compromise the character of the officer are eligible, as well as any behaviors that disgraced or dishonored the officer&#8217;s personal position. Although officers are not expected to have unrealistically high moral standards, there is a personal standard beyond which an officer cannot fall without significantly compromising their position in the military.<\/p>\n<p>In addition, Article 133 includes acts made punishable by other articles in the UCMJ if the acts are also considered to be conduct becoming an officer and gentleman. For example, stealing property falls under Article 121 (larceny and wrongful appropriation) as well as Article 133.<\/p>\n<p>Some examples of conduct unbecoming include the following:<\/p>\n<ul class=\" bullets bullets\">\n<li>Knowingly making a false official statement<\/li>\n<li>Cheating on a test<\/li>\n<li>Being drunk and disorderly in public<\/li>\n<li>Public association with known prostitutes<\/li>\n<li>Using insulting or defamatory language to an officer<\/li>\n<\/ul>\n<p><strong>PUNISHMENT<\/strong><\/p>\n<p>Regarding the punishment of conduct unbecoming an officer, the UCMJ has this to say: \u201cAny commissioned officer, cadet, or midshipman who is convicted of conduct unbecoming an officer and a gentleman shall be punished as a court-martial may direct.\u201d This can include dismissal, forfeiture of pay and allowances, and confinement.<\/p>\n<p>_____<\/p>\n<p><em>Conduct unbecoming an officer and gentleman&nbsp;<\/em>is a somewhat vague offense, so a strong counsel is important&nbsp;during trial.&nbsp;If<em>&nbsp;<\/em>you or someone you know is preparing for a court-martial, contact the top-quality lawyers at&nbsp;<a href=\"https:\/\/gapasinlaw.espresso.themodernfirm.com\/\">Newsom &amp; Gapasin<\/a>.
