Leadership, Not Misconduct: Marine Staff Sergeant Fully Acquitted at Court-Martial

December 18, 2024, U.S. v. E-6, United States Marine Corps, Camp Lejeune, North Carolina. Staff Sergeant in the United States Marine Corps served as the Section Chief of a team of welders. Known for his structured leadership and direct communication style, the Staff Sergeant maintained high standards and strict discipline among his Marines. Tensions arose when one Marine, frustrated with the Staff Sergeant's leadership approach, filed complaints alleging harassment, Equal Opportunity (EO) violations, and the use of racial slurs. Several other Marines later joined this Marine in his accusations, claiming the Staff Sergeant made racially charged remarks toward African American and Hispanic Marines, including making inappropriate jokes and using derogatory language. The Staff Sergeant consistently denied these allegations, but the Government prefers charges against him under Article 92 for violating lawful orders and negligent dereliction of duty, Article 93 for maltreatment of subordinates, and Article 128 for simple assault. Mr. Gapasin was assigned to represent the Staff Sergeant. From the outset, Mr. Gapasin recognized how Client, a highly disciplined Non-Commissioned Officer (NCO), was leading younger, less experienced Marines at one of the most demanding installations in the country. At trial, Mr. Gapasin conducts rigorous and strategic cross-examinations of these accusing witnesses. Through methodical questioning, he reveals inconsistencies, hearsay, and exaggerations in their testimony. The evidence was clear that the allegations stemmed from resentment toward the Staff Sergeant's strict leadership style, not necessarily from actual misconduct. After hearing all the evidence, the eight-member panel of officers and enlisted Marines deliberated for over four hours. RESULT: NOT GUILTY of ALL Charges and Specifications. NO Federal Conviction, NO Confinement, and NO Discharge.
