Officer Retains Career After Strategic Defense Exposes Fabricated Claims By Ex-Spouse
May 17, 2024, U.S. v. O-4, United States Army, Fort Carson, Colorado. Government initiates an AR 15-6 Investigation against a Major with over 18 years of service for allegations of child abuse, and for sexual harassment and bullying in his unit. Major's ex-wife engages in constant harassment against him by contacting his Chain of Command with multiple false allegations that he physically abused his children. The investigation for alleged child abuse is substantiated, but rather than finding sexual harassment or bullying, the investigator finds counterproductive leadership within his unit. Major is notified that he will facing separation in a Board of Inquiry and the Government would be pursuing an Other Than Honorable Discharge. Mr. Gapasin immediately begins investigating the allegations of child abuse and recognizes a number of credibility issues with the claims. Gapasin recognizes the clear motive to fabricate by the ex-wife by analyzing the timing at which she claims Gapasin's client abuses them. She made such claims to prevent client from picking up his children or when client wanted to assert his custody rights. Moreover, any claims of injuries to the children were always unverifiable and questionable. At the Board of Inquiry, Gapasin calls four witnesses to testify on behalf of his client regarding how good of a Dad he was and how he never used corporal punishment. One of the witnesses testified that she was present for the entirety of the time during which the ex-wife made claims that client abused the children. Gapasin's witness completely disputed ex-wife's allegations. This Board finds that Client did nothing counterproductive by exerting his authority to ensure other officers and Senior NCOs in the unit were properly preparing for an upcoming deployment. In other words, Board finds Client in the right, and the unit being counterproductive. RESULT: Board of Inquiry finds ALL allegations UNSUBSTANTIATED. Board RETAINS Major, NO Discharge, NO Other Than Honorable Discharge, and Mr. Gapasin SAVES CLIENT'S RETIREMENT.
